⚖️

Legal Review Notice: This document is a plain-language draft defining the coordinator role of KashiFuneral.com under the Consumer Protection Act, 2019 and the Indian Contract Act, 1872. Business owners should review and finalize these terms with a certified Indian legal advocate.

1. Business Role: Coordination and Assistance Platform

KashiFuneral.com operates strictly as an independent local facilitation, coordination, and assistance service based in Varanasi, Uttar Pradesh.

We assist bereaved families by coordinating logistics with independent local Vedic Pandits, timber suppliers, boat operators, and licensed hearse van drivers. KashiFuneral.com does not own, administer, or regulate the sacred ghats of Varanasi (which fall under public, religious, and municipal oversight by the Varanasi Nagar Nigam and local administrative authorities).

2. Booking Requests vs. Confirmed Bookings

Submission of an online form or contact inquiry on KashiFuneral.com constitutes an Initial Inquiry (Status: New Inquiry). It does not create a binding service contract.

A booking is considered confirmed only when:

  • Our duty coordinator confirms on-site availability of providers (e.g., priest or timber pyre slot).
  • The customer is presented with an itemized price estimate.
  • The customer gives explicit verbal or written approval to proceed.

3. Pricing, Itemized Estimates & Payment Methods

To maintain transparency and prevent financial distress:

  • All prices quoted are verified based on actual quantities (e.g., pyre timber weight, sandalwood additions, boat capacity, priest dakshina).
  • No Online Gateway Charges: We do not ask for online credit/debit card numbers or net banking passwords through this website.
  • Payments are settled directly with coordinators or providers through verified receipts, UPI transfers, or direct cash settlement as mutually agreed upon confirmation.

4. Customer Responsibilities & Statutory Documentation

The customer and family agree to provide accurate, honest information and strictly comply with local laws:

  • Mandatory Death Memo / Medical Certificate: The family must present a valid medical death memo or hospital death certificate before cremation or body transfer can take place at Varanasi ghats.
  • Government ID: The primary relative (Karta) must hold a valid government identity card.
  • Police NOC: In cases of accident, unnatural demise, or post-mortem requirements, all statutory police clearances must be furnished by the family. Coordinators cannot bypass statutory laws.

5. Force Majeure & Local Ghat Conditions

Funeral logistics along the Ganga are subject to physical conditions beyond our control, including monsoon flooding, strong water currents, VIP movement security restrictions, heavy ghat overcrowding, or municipal administrative orders.

In such situations, our duty coordinators will advise the family on the safest and most respectful alternative arrangements (such as shifting from Manikarnika to Harishchandra or utilizing electric crematoria).

6. Dispute Resolution & Jurisdiction

Any grievances should be promptly raised with our customer support coordinator. In the event of unresolved disputes arising under these Terms, the matter shall be governed exclusively by the laws of India, with exclusive jurisdiction resting in the competent courts of Varanasi, Uttar Pradesh, India.
